Scrutiny of Acts and Regulations Committee
The Scrutiny of Acts and Regulations Committee (SARC) is an all-party Joint House Committee, which examines all Bills introduced into the Victorian Parliament to determine whether they are incompatible with Human Rights.
It has just been announced that SARC will be taking submissions from the public on their views about the COVID-19 Omnibus (Emergency Measures) and Other Acts Amendment Bill 2020(Vic) up until 5pm this Wednesday 7/10/20.
We’ve made it easy for you to have your say via the link below.
Here are some points which you may wish to include in your submission:
- The preemptive detention proposed by the Bill beaches sections 21, 12 & 8 of the Charter of Human Rights and Responsibilities Act 2006 (Vic) which protects individuals from being subjected to arbitrary detention, and the right to enjoy freedom of movement and human rights without discrimination
- High risk individuals’ could be arbitrarily detained in breach of section 21 of the Charter of Human Rights and Responsibilities Act 2006.
- Proposed amendments would allow for untrained individuals to be appointed as Authorised Officers
- Under the Bill, the authorised officer is responsible for reviewing their own decision to detain individuals meaning the person making the decision is also responsible for reviewing their own decision. There is also no provision for a review of the detention which means a person may need to apply to the Supreme Court to grant an order for release.
Fill in the form below and we will send it as an email to all 7 members of the SARC Committee.
Once you’ve filled the form out, please ask your family and friends to also do the same.
